Getting the Interim Protection Order
A Domestic Violence Protection Order is a temporary and urgent legal protection order that can be used as guard against matters dealing in domestic violence. This order helps to sort pending investigations by the police following an investigation to the commission of the offence involving domestic violence.
One such example of domestic violence is violence between husband and wife. Usually few of them give up and return to their
partners for the fear of society and social norms. While few others, end up their life because they feel that they are being a burden on their loved ones and friends. The abusive partner are never able to digest the bold step taken by their partner as they have lived this long using their power and unwanted interruptions over the weaker half and it usually results in cruel harassments. This law came into existence when such cases increased.
Below are some points that should be acted upon quickly in order to take some preventive steps:
- In case you have been assaulted physically, seek immediate medical assistance at the nearest Government hospital. Don’t forget to ask for the Medical Report
- Go to the nearest Police Station of the department of Social Welfare and seek assistance to lodge a police report against the culprit. Ask for a copy of your Report Number
- Tell the Police or the Welfare Officer that you need an Interim Protection Order(IPO). The Police officer or Welfare Officer wily out o get an IPO in the court.[Remember to ask the names of the Police Officer/Welfare Officer assigned to you & also get their telephone numbers]
- If you fear that you might again get into some physical harassment then ask the Court to add a power of arrest to the IPO.
- Report quickly any violation of the order to Police Officer or the Welfare Officer.
- If the culprit is charged with a crime, you can apply Protection Order and Court can make further orders related to it.
A protection order is much reliable as the issue can be sought during criminal proceedings under the Penal Court during the trial of the culprit. In case one is a victim of any such violence, it is advisable to have a lawyer for your protection when one is going to attend court to provide evidence against the offender.
