Malaysian Court System
THE SUPERIOR COURTS
The superior courts consists of the High court in Malaysia, High court of Sabah and Sarawak, the court of appeal and the federal court. In all of the above the federal court is the highest court of this land.
The High Courts
All the courts are under the supervisory of the High court. The complaints of the crimes and civil matters are heard here. Matters that urge in common life like divorce, bankruptcy, different problems that urge when children start to grow up, car accidents etc. The
high court has the power to listen to the matter and act according to the law. What is said by the high court is then final and no arguments are to take place.
The Court of Appeal
The court of appeal mainly deals with civil problems and listens to those voices that stand against the decision of the High court except to those orders that have been set by consent. The court of appeal could help things out but most of the time things settle with the decision of the High court itself.
The criminal appeals against High court are even heard at the court of appeal.
The Federal Court
It all goes down like a ladder, after the court of appeal stands the federal court. If things dint go well for you at the court of appeal then you may have a chance at the Federal court. It also hears appeal of the criminals who have been rejected at the court of appeal but Federal court listens to the case set on the base of the high court.
THE OTHER SUBORDINATE COURTS
The subordinate courts consists of the Magistrates courts and the Penghulu’s court which lies in the west Malaysia.
The Penghulu’s Courts
When the claim of a case does not exceed RM50-00 then these types of cases are gone through again in the Penghulu’s court. The Penghulu’s court reduces the punishment and puts up a fine mostly.
The Magistrates’ Courts
The claim that does not even exceed RM25000-00 is again gone through in the Magistrates court. This court generally deals in the criminal matters. They have a power to impose a maximum punishment of 10 years and put fines. It also hears the appeals from the Penghulu’s court.
